This website is operated by Datum Press. Throughout the Site, the terms “we,” “us,” and “our” refer to Datum Press. Datum Press offers this website, including all information, tools, products, and services available through it, conditioned upon your acceptance of these Terms of Service (“Terms”).

By visiting datumpress.co, purchasing from us, or otherwise using the Site or Services, you agree to these Terms and the policies referenced in them. If you do not agree, do not access or use the Services.

We may update these Terms by posting a revised version on the Site. Changes apply from the stated effective date. Your continued use of the Services after a change means you accept the revised Terms, to the extent permitted by law.

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to sell products and services to you.

1. Eligibility and acceptable use

You must be at least the age of majority in your state, province, or country of residence, or have permission from a parent or legal guardian, to use the Services or make a purchase.

You may not use the Services or our products for an unlawful, fraudulent, abusive, infringing, or unauthorized purpose. You must not introduce malware, attempt to gain unauthorized access, interfere with the Site, scrape the Site in violation of applicable law, misuse promotions, or violate the rights of another person.

We may suspend or terminate access where we reasonably believe these Terms have been violated.

2. Product information

We work to display product descriptions, materials, editions, dimensions, colors, images, finishes, and availability as accurately as reasonably possible. Screen settings, lighting, photography, paper and ink characteristics, hand-finishing, production methods, and normal manufacturing variation may cause minor differences between the product shown online and the item received.

Product packaging, paper stock, materials, finishes, and minor design or production details may be updated without notice, provided the product remains materially consistent with its description. Where a particular dimension, material, finish, color, edition, or display requirement is important to you, contact us before ordering.

Unless expressly stated otherwise, frames, mounts, display stands, hanging hardware, props, furniture, and other items shown in lifestyle images are not included.

Some products may require framing, mounting, assembly, or particular handling and care. Any material requirements will be stated in the product description where relevant. You are responsible for checking dimensions and suitability for your intended display location before purchase.

3. Prices and payment

Prices, discounts, promotions, product availability, and shipping charges may change without notice. The price charged is the price shown at checkout when you place the order, subject to correction of obvious errors.

Taxes, duties, and fees may be added where required. You agree to provide current, complete, and accurate billing and payment information and authorize us and our payment providers to charge the amount shown at checkout.

If a pricing, description, availability, or calculation error affects an order, we may contact you to confirm the corrected terms or cancel and refund the affected order.

4. Orders

An order confirmation acknowledges that we received your order; it does not necessarily mean that the order has been accepted. We may accept, reject, limit, or cancel an order for legitimate reasons, including suspected fraud, payment failure, inventory error, shipping restriction, reseller activity, obvious pricing error, or legal or safety concerns.

If we cancel an order after payment, we will refund the cancelled amount. We may limit quantities purchased per person, household, account, payment method, address, or order.

You are responsible for reviewing your order and ensuring that your contact, billing, and shipping information is accurate before submitting it.

5. Shipping, returns, and refunds

Shipping and delivery are governed by our Shipping Policy. Returns, exchanges, cancellations, and refunds are governed by our Refund Policy. Those policies form part of these Terms.

Risk of loss and title pass as provided by applicable law. Nothing in these Terms limits rights that cannot lawfully be excluded.

6. Promotions, discount codes, and gift cards

Promotions and discount codes are subject to any terms communicated with the offer. Unless stated otherwise, offers cannot be combined, applied to previous purchases, exchanged for cash, or transferred. We may withdraw or correct a promotion affected by fraud, abuse, technical error, or unauthorized distribution.

Gift cards are subject to applicable law and any terms stated when purchased or issued.

7. Optional tools and third-party services

We may provide access to tools, integrations, content, payment methods, tracking services, apps, or links supplied by third parties. Third-party services are provided under their own terms and policies. We do not control them and are not responsible for their independent acts, omissions, content, availability, or security, except to the extent required by law.

8. Reviews, feedback, and submissions

If you submit reviews, suggestions, photos, videos, comments, ideas, or other content, you grant Datum Press a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display that content for operating, improving, and marketing the Services, subject to applicable law and our Privacy Policy.

You represent that you have the necessary rights to submit the content and that it is accurate, lawful, and does not infringe or harm another person. We may remove content that is unlawful, misleading, abusive, infringing, obscene, fraudulent, or otherwise inappropriate.

9. Intellectual property

The Site and its content—including branding, logos, graphics, photographs, videos, text, product copy, page design, and software—are owned by or licensed to Datum Press and are protected by intellectual-property laws. Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, license, publish, create derivative works from, or commercially exploit Site content without prior written permission.

Third-party names, products, logos, and trademarks remain the property of their respective owners. Reference to them does not imply endorsement unless expressly stated.

10. Prohibited conduct

You may not use the Site or Services to:

• Infringe intellectual-property, privacy, publicity, or other rights;

• Submit false, misleading, fraudulent, abusive, or malicious content;

• Transmit malware or harmful code;

12. Limitation of liability

To the fullest extent permitted by law, Datum Press and its owners, officers, employees, affiliates, agents, contractors, licensors, service providers, and suppliers will not be liable for indirect, incidental, punitive, special, exemplary, or consequential loss arising from the Services or products, including lost profits, lost revenue, lost savings, lost data, replacement costs, or similar damages.

To the fullest extent permitted by law, our aggregate liability relating to an order will not exceed the amount you paid us for the product giving rise to the claim.

These limitations do not apply where liability cannot lawfully be limited or excluded, including for fraud, willful misconduct, or other liability protected by applicable law.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Datum Press and its affiliates, owners, officers, employees, agents, contractors, licensors, service providers, and suppliers from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Services, your breach of these Terms, or your infringement of another person’s rights.

14. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy. Shopify and other providers may separately process personal information under their own privacy policies.

15. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.

16. No waiver

Our failure to enforce a provision of these Terms does not waive that provision or any other right.

17. Entire agreement

These Terms and the policies posted on the Site constitute the entire agreement between you and Datum Press concerning the Services and supersede prior communications concerning the same subject matter.

18. Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets, subject to applicable law.

19. Governing law

These Terms and any separate agreement through which we provide Services are governed by the laws applicable in the State of Texas, without regard to conflict-of-law principles, except where the mandatory consumer laws of your place of residence apply.
